Republicans buried Merrick Garland for nearly a year until he simply disappeared.
Chuck Schumer just promised Senate Democrats will run that exact play on Donald Trump's next nominee.
Republicans say losing the Senate this fall could freeze the Supreme Court for 25 years.
The 2016 Merrick Garland Blockade That Buried His Supreme Court Nomination
In 2016, Senate Republicans refused to give Merrick Garland a hearing, a vote, or even a meeting with most of the Judiciary Committee.
They sat on the nomination for months.
They ran out the clock until voters elected a new president.
It worked. Garland never set foot on the bench, and Neil Gorsuch took the seat instead.
Democrats called it theft for a decade.
Now Schumer is openly preparing to do the same thing to Trump, and he isn't hiding it.
"The bottom line is one of the reasons that we want to make sure we do everything we can to take back the Senate is not let Trump put such horrible justices, MAGA justices on the Supreme Court and the lower courts," Schumer said.
That is not a slip of the tongue.
That is a Senate minority leader telling voters exactly what he plans to do with the power he's asking for.
Sen. Steve Daines, who ran the GOP's Senate campaign arm in 2024, says Republicans have been too quiet about what's actually on the ballot.
"If we have a vacancy, Sotomayor, Clarence Thomas, who knows – President Trump could not move through a Supreme Court justice," Daines told Fox News Digital.
Daines called it "silver buckshot," one of several messages Republicans need voters to hear before November.
Alito's Retirement Denial Exposes Schumer's Supreme Court Vacancy Plan
Here's what makes this worse than a garden-variety campaign threat.
Justice Samuel Alito confirmed back in August that he's staying on the Supreme Court for another term, a decision Trump cheered as "great news."
But in a CBS interview last month, Alito admitted he'd considered retiring earlier this year and said it's "something I think that somebody at my age has to think about every term."
Clarence Thomas is 78. Alito is 76.
Sonia Sotomayor is 72 and has had well-documented health issues for years.
Any one of those seats could open without warning.
Senate GOP leadership is reportedly prepared to confirm an Alito replacement before the midterms, with Majority Leader John Thune ready to push a nominee through fast.
Schumer isn't waiting to see who actually leaves the bench.
He's pre-committing to obstruction before there's even a nominee to fight.
That's the tell.
Republicans tried the no-hearing, no-vote strategy once, on one nominee, in one election year, and spent the next decade getting hammered for it in the press.
Schumer wants to run it as standing policy for the next six years, regardless of who Trump picks or why.
NRSC spokeswoman Bernadette Breslin put it bluntly, warning that the court "would cease to exist" under the kind of Senate Democrats like Troy Jackson, Abdul El-Sayed, and James Talarico are campaigning to build.
Why Senate Control in the 2026 Midterms Decides Trump's Next Supreme Court Pick
This is the part campaign ads keep skipping.
A Supreme Court seat isn't like a Cabinet post Trump can staff on his own authority.
No Senate majority, no justice. Full stop.
Hand Schumer the gavel and he doesn't need a reason to kill a nomination. He just needs the votes, and he's already telling you he'll use them.
Senate Republicans already changed the rules last year just to push Trump's executive nominees past Schumer's blockade.
A Supreme Court pick would face the exact same wall, except this one lasts for decades, not four years.
Schumer is telegraphing this fight 34 days before Election Day, not after some accident forces his hand.
The fight over one Senate majority could decide who sits on that court for the next generation, and Chuck Schumer just told you, on the record, that he intends to make sure it isn't anyone Donald Trump picks.
