Several high-profile cases are on the docket for the new Supreme Court term.
It doesn’t look good for Democrats.
Clarence Thomas asked one question that has Democrats on edge about the upcoming Supreme Court term.
The constitutionality of affirmative action programs at the University of North Carolina and Harvard will be decided by the Supreme Court during the new term.
Justice Clarence Thomas used the oral arguments for the case to express his opposition to affirmative action programs.
“I’ve heard the word ‘diversity’ quite a few times, and I don’t have a clue what it means. It seems to mean everything for everyone,” Justice Thomas declared. “I’d also like you to give us a clear idea of exactly what the educational benefits of diversity at the University of North Carolina would be.”
In the past, the Court upheld the controversial practice of affirmative action.
However, Thomas’ opinions in the cases made it clear he believes the program is racist.
“I note that racial engineering does in fact have insidious consequences,” Thomas wrote in a case involving affirmative action at the University of Texas. “There can be no doubt that the University’s discrimination injures white and Asian applicants who are denied admission because of their race. But I believe the injury to those admitted under the University’s discriminatory admissions program is even more harmful.”
Under affirmative action, minority applicants get accepted to more prestigious schools that they would not qualify for if held to the same standards as everyone else.
“Blacks and Hispanics admitted to the University as a result of racial discrimination are, on average, far less prepared than their white and Asian classmates,” Thomas added.
“The University admits minorities who otherwise would have attended less selective colleges where they would have been more evenly matched,” Justice Thomas argued. “But, as a result of the mismatching, many blacks and Hispanics who likely would have excelled at less elite schools are placed in a position where underperformance is all but inevitable because they are less academically prepared than the white and Asian students with whom they must compete. Setting aside the damage wreaked upon the self-confidence of these overmatched students, there is no evidence that they learn more at the university than they would have learned at other schools for which they were better prepared. Indeed, they may learn less.”
The Court handed the Left two huge losses during the last term by expanding the scope of the Second Amendment and overturning Roe.
Affirmative action is up for consideration this term.
Justice Thomas wants to end it with one big swoop.
Although all six conservatives have expressed some level of opposition to affirmative action, how far the other Justices are willing to go remains up in the air.
