Fulton County, Georgia prosecutor bet her political future on turning one phone call into the smoking gun that would take down Donald Trump.
But it looks like there’s a fatal flaw in her plan.
Willis’ entire witch hunt hinged on a January 2, 2021, phone call President Trump made to Georgia Secretary of State Brad Raffensperger.
“All I want to do is this: I just want to find 11,780 votes, which is one more than we have. Because we won this state, and flipping the state is a great testament to the country,” Trump reportedly told Raffensperger. “I only need 11,000 votes. Fellas, I need 11,000 votes. Give me a break.”
“It’s just not possible to have lost Georgia. It’s not possible,” Trump added.
Willis is claiming that by questioning if he really lost the state by a single vote, Trump was pressuring Raffensperger to commit election fraud.
She then extrapolated that to become a centerpiece of a 41-count indictment against the former President and 18 of his associates.
Harvard law professor Alan Dershowitz was able to immediately point out a massive problem in her approach.
“If I were a defense lawyer in this case, I would start with that phone call. It’s the most exculpatory piece of evidence,” Dershowitz told Fox Business host Larry Kudlow.
Dershowitz explained that the idea that the phone call is “exculpatory” evidence that hinges on the dictionary definition of the word “find.”
Trump did not ask Raffensperger to come up with fake votes to help him win Georgia.
Instead, Dershowitz pointed out that Trump was asking Raffensperger to recount the ballots in order to find any votes Trump believed were legally cast and missed during the counting.
Dershowitz’ experience comes from the other side of the game, since he worked on Al Gore’s legal team in the 2000 election.
That time Democrats were seeking a recount to find the ballots the Gore team believed would prove their guy–not George W. Bush–won in Florida.
“The word ‘find’ has a dictionary meaning. It means they’re there, they’re there to be found. Just please look hard and look for them. That’s what we did in Florida. We thought there were enough votes that could put Gore over the top,” Dershowitz said.
Now Willis is attempting to use the controversial RICO laws to criminalize standard legal advice and accepted political practices.
Dershowitz warned the DA is treading on dangerous ground—especially since voters already have the right to choose not to reelect Donald Trump if they don’t approve of how he handled the last election.
“There was possibly more that could be done but in any event you don’t make it a crime if it is a matter of degree,” Dershowitz explained. “You say to people don’t do it next time or you condemn people. You don’t vote for them. That is the ultimate check and balance. Don’t vote for them.”
Clearly, Democrats don’t trust American voters to run this country—and the last thing they want is the opportunity for citizens to replace the senile and confused Joe Biden with Donald Trump.
