And Jack Smith is furious after Donald Trump forced his hand to make one move he hoped to never do.
The lawfare comes to an end… for now
President Joe Biden and Vice President Kamala Harris had put all their chips behind Jack Smith to become former President Donald Trump’s biggest obstacle on the campaign trail.
They had hoped his relentless lawfare against Trump would keep him from ever returning to the White House.
But Smith’s attempt at performing mental and legal gymnastics caused a chain series of events in the courts that caused Smith to take five steps backward for every one step forward.
Judge Aileen Cannon handed a massive blow to Smith’s efforts when she tossed out entirely the failed Mar-a-Lago document hoax when she discovered that Attorney General Merrick Garland completely violated the appointments clause in the Constitution when he hired Smith to the helm as special counsel.
And the Supreme Court completely shredded the January 6 political witch hunt against Trump when they issued their Presidential immunity ruling.
As a result, both cases have been caught up in a judicial limbo, with neither case having the ability to make it before a judge within a year, not including the multitude of appeals that are likely to occur.
This would mean that Smith has no chance to bring Trump back into a courtroom before he is sworn in as President on January 20.
Jack Smith was a relentless fanatic who would bend and skip the law to his benefit, all with the goal of trying to go after Trump.
But even Smith knew that he had already missed his chance.
Just one day after it was announced that Donald Trump was elected President, Smith began hosting meetings to figure out how to bring his cases against Trump to a close.
The Hill reported, “Special counsel Jack Smith is evaluating how to wind down the two federal cases launched against President-elect Trump following his Election Day victory, a move that would align with Justice Department policy barring the prosecution of sitting presidents.”
“A Trump-led Justice Department was widely expected to move to withdraw the charges against Trump, but Smith’s team is discussing pulling back in the cases ahead of the Inauguration,” continued the report.
At odds with a 1970s OLC memo
Smith was outplayed by Trump as a result of an Office of Legal Counsel (OLC) memo issued in 1973 stating that the Justice Department did not have the ability to press criminal charges against a sitting President.
The OLC memo stated, “The Department concluded that the indictment or criminal prosecution of a sitting President would impermissibly undermine the capacity of the executive branch to perform its constitutionally assigned functions.”
Spokesman for the Trump campaign, Steven Cheung, issued his own statement noting that with the election being decided and over, so was the lawfare and abuse of the justice system that was being used against Trump.
“The American people have re-elected President Trump with an overwhelming mandate to Make America Great Again,” began Cheung in his statement.
“It is now abundantly clear that Americans want an immediate end to the weaponization of our justice system, so we can, as President Trump said in his historic speech last night, unify our country and work together for the betterment of our nation,” his statement added.
Trump had previously told popular radio host Hugh Hewitt that he would fire Jack Smith on his first day in office.
“It’s so easy, I would fire him within two seconds,” Trump told the radio host.
Trump then added, “Discretion is the better part of valor.”
And Smith finally making the decision to call it quits on going after Trump may very well be a perfect example of just that.
