The FBI raid on Donald Trump’s home is turning into a problem for Joe Biden.
The FBI lost the first major legal battle in the case.
And Joe Biden is troubled after one judge handed Donald Trump a huge victory over the FBI.
When Donald Trump asked for a judge to appoint a Special Master to sort through the documents seized by the FBI and remove anything not covered by his claim of executive privilege, left-wing legal analysts mocked his court filing.
Even though the “experts” on social media and cable news claim otherwise, the reality is that the issue of a former President’s right to assert executive privilege has never been fully litigated in court.
Since the issue is not settled, Judge Aileen Cannon agreed that prosecutors from the Biden administration tainted the investigation by seizing materials that they may have not had the authority to access.
Judge Cannon’s ruling called out the political nature of the Biden administration raiding the home of the leader of the opposition Party.
“The Government implies that additional independent review for attorney-client privilege, such as by a Special Master, is appropriate only when a search of a law firm occurred. Whatever the extent of this argument, it fails decisively here. True, Special Masters ordinarily arise in the more traditional setting of law firms and attorneys’ offices. But the Court does not see why these concerns would not apply, at least to a considerable degree, to the office and home of a former president. Moreover, at least one other court has authorized additional independent review for attorney-client privilege outside of the law firm context, in politicized circumstances,” Judge Cannon stated.
Because the Biden administration could selectively give information to the press designed to make Trump look bad, Judge Cannon paused the investigation.
“In addition to being deprived of potentially significant personal documents, which alone creates a real harm, Plaintiff faces an unquantifiable potential harm by way of improper disclosure of sensitive information to the public,” Judge Cannon continued.
The Washington Post already did this when it published a fake story based on leaks from Biden administration officials that Donald Trump put the country in danger by stealing America’s secrets about its nuclear weapons program.
Judge Cannon’s ruling is a big loss for the FBI.
Not only could it potentially cripple the entire investigation, but it could also set a new precedent regarding the extent of executive privilege.
