President Trump is already facing an onslaught on judicial tyranny where to get any aspect of his agenda in place he must go 677-0 in federal district courts.
Since Barack Obama and Joe Biden appointed more than 400 of these district court judges Democrats are setting national policy even though Republicans won the election.
Leftist judges anointing themselves dictator has played out in immigration case after immigration case where these city judges are blocking President Trump from deporting illegal aliens.
Now President Trump’s Liberation Day tariffs are under siege.
A three-judge panel on the Court of International Trade blocked Trump’s tariffs even though the plain statutory language of the International Emergency Economic Powers Act gives the President the power to declare a national emergency and impose tariffs.
By claiming the President was wrong to declare trade deficits and fentanyl a national emergency, these three judges are now deciding political questions instead of legal disputes.
White House Press Secretary Karoline Leavitt ripped these out-of-control judges a new one for their lawless power grab.
Leavitt goes ham
“Last night, the Trump administration faced another example of judicial overreach. Using his full and proper legal authority, President Trump imposed universal tariffs and reciprocal tariffs on “Liberation Day” to address the extraordinary threat to our national security and economy posed by large and persistent annual U.S. goods trade deficits,” Levitt began.
Leavitt then offered up a brief history of the United States’ trade deficits and how one-sided globalist trade deals gutted the American Middle Class.
“The United States has run a trade deficit of goods every year since 1975. In 2024, our trade deficit in goods exceeded $1 trillion. Everybody agrees this is unacceptable. President Trump is delivering on his promise to fix this problem, and he has taken a long overdue and much needed bold stance for American workers after decades of our manufacturing base being hollowed out,” Leavitt added.
Donald Trump won the election on a promise to renegotiate fair trade deals that benefit the American worker.
“The president’s rationale for imposing these powerful tariffs was legally sound and grounded in common sense. President Trump correctly believes that America cannot function safely long-term if we are unable to scale advanced domestic manufacturing capacity, have our own secure critical supply chains, and our defense industrial base is dependent on foreign adversaries,” Leavitt continued.
But now three unelected judges in New York took it upon themselves to declare that they are in charge of U.S. trade policy.
“Three judges of the U.S. Court of International Trade disagreed and brazenly abused their judicial power to usurp the authority of President Trump to stop him from carrying out the mandate that the American people gave him. These judges failed to acknowledge that the President of the United States has core foreign affairs powers and authority given to him by Congress to protect the United States economy and national security,” Leavitt concluded.
