Democrat prosecutor Fani Willis’ indictment against Donald Trump has left many legal experts scratching their heads as to how she plans to indict someone for routine election challenges.
The truth behind the indictment is becoming clearer and it doesn’t sit well with a former federal prosecutor who is now blowing the whistle on what he says are Fani Willis’ motivations.
In a recent op-ed for The Daily Caller, former federal prosecutor Brett Tolman picked apart Fulton County Democrat District Attorney Fani Willis’ fantastical RICO indictment against former President Donald Trump for his alleged role in some sort of criminal conspiracy to somehow alter the results of the state’s 2020 election.
Of course, the fact that Willis chose to hit Trump and 18 co-defendants with a RICO indictment typically reserved for organized crime, like the mafia or international drug cartels, is more than baffling to most legal experts.
Tolman is amongst those who can’t seem to make sense of Willis’ efforts, and as he explained, the most glaring issue with her RICO indictment against Trump is the fact that RICO indictments require evidence that the defendant engaged in actions to advance a criminal enterprise, but the Democrat DA’s indictment includes zero evidence that any such criminal enterprise even exists.
“I’ve read through the indictments, and as a former federal prosecutor who has jailed gangsters, gang members and sicarios under RICO statutes, all I see in this are the normal, mundane actions of attorneys objecting to how an election was conducted,” Tolman wrote. “RICO charges depend on overt acts, in furtherance of a criminal enterprise. What’s the criminal enterprise here?”
As the former federal prosecutor went on to point out, in a typical conspiracy case, charges are brought against members of the criminal enterprise for specific illegal actions they took to advance the larger criminal enterprise.
But in the case of Trump’s indictment, no illegal conspiracy exists, just routine election challenges conducted out in the public by attorneys of the campaign.
“In a typical conspiracy charge, it’s a gang associate, for example, who drives a vehicle with methamphetamine in the trunk from Point A to Point B — an illegal action, in furtherance of a bigger illegal conspiracy,” Tolman noted. “But in the Trump indictments, there’s no illegal conspiracy — just a not-unusual election challenge, right out in the open.”
So, if Willis’ indictment against Trump lacks all the evidence required to actually produce a conviction, what’s the point?
According to Tolman, he believes Willis merely wanted the same media spotlight Manhattan Democrat District Attorney Alvin Bragg received when he indicted the former President.
“Clearly, this isn’t about Trump — it’s about Fani Willis and her future in progressive politics,” Tolman concluded. “She wanted her Alvin Bragg moment; she got it.”
Now that Fani Willis got the attention she so desperately needs, she’s going to have to actually attempt to prosecute a completely bogus case while the entire world watches.
And that likely won’t go very well for her.
