Donald Trump successfully nominated three new Supreme Court Justices during his four years in the White House.
Neil Gorsuch was Trump’s first successful Supreme Court confirmation.
And Neil Gorsuch just handed down a ruling that will infuriate Joe Biden and the Democrats.
Last week the Supreme Court issued a ruling on an illegal immigration case involving Clemente Pereida, an illegal alien arrested and convicted of using a fake social security number.
Previously, under the Immigration and Nationality Act, illegal aliens are allowed to block their deportation if they can prove the crime they were arrested for doesn’t involve “moral turpitude.”
However, the Supreme Court just ruled in a 5-3 decision (Amy Coney Barrett recused herself because she wasn’t a member of the Supreme Court when oral arguments began) that the burden of proof when canceling their deportations lies solely on the illegal alien.
The Blaze reports, “In this case, while his deportation proceedings were already underway, Pereida was convicted in Nebraska of using a fake Social Security card in order to obtain employment, a crime involving moral turpitude, and so the immigration judge ruled he was ineligible to seek cancelation. However, the specific Nebraska statute that Pereida violated listed several offenses, one of which — operating a business without a license — did not involve moral turpitude.”
Justice Neil Gorsuch ruled that it was up to illegal aliens to prove their crime did not involve “moral turpitude” – unlike standard criminal cases where the burden of proof lies with the prosecution.
“The Immigration and Nationality Act expressly requires individuals seeking relief from lawful removal orders to prove all aspects of their eligibility. That includes proving they do not stand convicted of a disqualifying criminal offense,” Gorsuch wrote.
Of course, although only a small step in the right direction, this ruling is still a victory for America First Republicans who oppose the Democrats’ open border agenda.
