SCOTUS Justices have Jack Smith terrified his demands could end with Barack Obama behind bars

Democrats’ plan to utilize a lawfare strategy to keep Donald Trump from returning to the White House hasn’t exactly gone the way they hoped it would.

But it’s now turning into a full-blown catastrophe that could have more serious far-reaching consequences than anyone thought possible.

And now SCOTUS Justices have Jack Smith terrified that his demands could end with Barack Obama behind bars.

Reckoning looms

Special Counsel Jack Smith’s January 6 witch hunt against former President Donald Trump has been on hold for months now after Trump appealed a lower court’s decision to reject his request to be shielded from the prosecution due to Presidential immunity.

Trump’s legal team has argued that because he was President on January 6, he should have “absolute immunity” from such criminal prosecutions as his case could set a precedent that would “incapacitate every future President.”

Meanwhile, Smith and his team recently filed a brief with the Supreme Court demanding that the Justices reject Trump’s appeal, effectively setting a precedent that would eliminate Presidential immunity.

“The President’s constitutional duty to take care that the laws be faithfully executed does not entail a general right to violate them,” Smith’s filing with the Supreme Court read.

“The effective functioning of the Presidency does not require that a former President be immune from accountability for these alleged violations of federal criminal law,” the filing continued. “To the contrary, a bedrock principle of our constitutional order is that no person is above the law — including the President.”

Smith’s primary concern, of course, is that the Court could decide in Trump’s favor, establishing a standard for Presidential immunity that a lower court would then use to determine whether or not the former President’s case rises to such a level that still warrants prosecution, thereby further delaying his witch hunt, and making it nearly impossible for Trump to be imprisoned prior to November’s General Election.

Stark truths

But as Trump’s legal team alluded to when they warned that rejecting their Presidential immunity defense could “incapacitate” other Presidents, Smith’s efforts will have unintended consequences.

Mainly, if Smith succeeds in convincing the Court to reject Trump’s Presidential immunity claims, and the former President still happens to win the 2024 election, his Department of Justice could very well use the ruling against him as a precedent to give Democrats a taste of their own medicine.

For example, back in 2011, former President Barack Obama unilaterally ordered drone strikes in Yemen that resulted in the deaths of two American citizens, Anwar al-Awlaki and his 16-year-old son, Abdulrahman Anwar al-Awlaki.

Should Smith succeed in convincing the Supreme Court that Presidential immunity doesn’t exist, Obama could very well be prosecuted for murdering those two Americans.

Once again, Democrats’ lust to thwart Donald Trump has completely blinded them to the true reality of their actions.
