In a stunning twist, Judge Aileen Cannon eviscerated Special Counsel Jack Smith for his indictment of former President Donald Trump in the classified documents case.
Judge Cannon chastised Smith’s decision to keep a Washington, D.C. Grand Jury active for the sole purpose of investigating Trump in a case that will be tried in Florida.
As a matter of fact, she even went so far as to actively encourage Trump’s legal team to object to the use of an out-of-state Grand Jury to investigate the case as it could rise to the level of Grand Jury abuse.

In doing so, Cannon has effectively laid the groundwork for the entire case against the former President to potentially be thrown out due to such prosecutorial misconduct.
Smith had previously run the entire investigation into Trump’s alleged mishandling of classified documents at Mar-a-Lago through the Washington, D.C. Grand Jury, and only moved the case to Florida when it became clear that not doing so would create a jurisdiction issue.
Of course, the reason Smith likely ran the investigation through a Washington, D.C. Grand Jury – and according to the Judge, continues to do so – is that he knew that there would be an anti-Trump lean to the jury pool, as 95% or more of those who live in Washington, D.C. voted against Trump.
Meanwhile, if Smith would have run the Grand Jury out of Florida, he obviously would have had a more difficult time purging the jury pool of anyone who voted for Trump.
This also isn’t Smith’s first rodeo with attempting to manipulate the judicial system to target Democrats’ political opponents.
The Supreme Court unanimously voted to overturn Smith’s conviction of former Virginia Republican Governor Bob McDonnell, as the Justices ruled that the interruption of a bribery statute the Special Counsel invented to produce the conviction was so broad that it criminalized routine daily duties of office.
Jack Smith and his fellow Democrats have gone to great lengths to stack the deck against former President Donald Trump as much as possible.
But when it comes to Judge Aileen Cannon, they may have just met their match.
