CBP Commissioner Ends the Border's Last Biden-Era Charity Pipeline
Rodney Scott didn't mince words when he killed it.
The CBP commissioner pulled his agency out of DHS Delegation 07107 effective immediately.
That order let CBP and ICE solicit gifts from private citizens and groups meant for illegal immigrants sitting in federal custody.
Then-Deputy DHS Secretary John Tien signed the delegation back in May 2022, right as Biden's border was falling apart by the day.
Scott's memo laid out exactly why the charity pipeline had to go.
"This delegation order is no longer needed or appropriate," Scott wrote.
He said the sharp drop in encounters and apprehensions means CBP simply doesn't need private donations anymore.
Translation: nobody's showing up to give gifts to.
For fifteen straight months, CBP has released zero illegal immigrants into the country.
Apprehensions have plunged 94 percent since Trump reclaimed the border.
Scott made the math painfully simple.
No crossings, no need for a donation program built to soften Biden's chaos.
Even Republicans Never Wanted This Made Permanent
Go back to 2019 and Republicans actually pushed for something like this, but not what Biden built.
Ted Cruz asked DHS to accept diapers and soap for kids stuck in overwhelmed facilities during a genuine emergency surge.
That was a temporary fix for a temporary crisis, floated by a senator trying to help agents who were drowning.
Biden's DHS took that idea in 2022 and turned it into standing bureaucracy, a permanent delegation of authority that assumed the crisis would never end.
It assumed wrong.
Scott's memo is really just closing the loop Republicans always intended: help when there's an emergency, not a taxpayer-adjacent charity drive for people who shouldn't be here in the first place.
The Program Trump Inherited and Buried
Biden's DHS didn't just tolerate mass illegal crossings, it built government machinery to make migrants comfortable while they waited.
The 2022 delegation gave CBP and ICE commissioners standing authority to solicit and accept gifts for people who crossed the border illegally.
It existed because Biden's own policies created record custody numbers that overwhelmed federal facilities.
Scott's memo said the order no longer matched the administration's tougher enforcement posture at the border.
It's not an isolated cleanup either.
CBP has been peeling back a whole slate of Biden-era leniency rules for migrants processed at the border, including special handling protections officials now call obsolete.
Border agents get one job under Trump — enforce the law, not run a hospitality desk for people who broke it.
The Same Fight Just Moved To The Supreme Court
Scott can kill a memo overnight. Democrat-appointed judges and immigration attorneys can't be shut down that easily, and they're now taking the leniency fight straight to the justices.
The Supreme Court agreed this year to decide whether the government must give bond hearings to noncitizens held for months or years while their cases wind through court.
Immigration lawyers pushed the case hoping the justices would force Trump's DHS back into releasing people the same way Biden did.
They've tried this before.
Ten years ago, the Supreme Court already ruled on a nearly identical fight and sided with the government over migrants seeking automatic release.
Justice Samuel Alito wrote that decision for a narrow conservative majority, rejecting the lower court's attempt to rewrite immigration law from the bench.
Trump's legal team is betting the same conservative wing still sees it that way, the same way Scott is betting the numbers speak for themselves.
If they're right, tens of thousands of noncitizens sitting in ICE custody today stay exactly where they belong — locked up, not out on the streets waiting on a court date that may never come.
Here's what fires me up about this story: Biden's administration didn't just fail to stop the border crisis, it built a whole support system to make it easier to break the law and feel comfortable doing it.
Government workers were out there soliciting donations for people who walked across an international border illegally, while American families in border towns dealt with overwhelmed schools, hospitals, and police departments.
Trump's team didn't need a task force or a congressional hearing to end it.
Rodney Scott read the numbers, saw the border was finally shut, and buried the whole program with one memo.
That's the difference between an administration that manages a crisis and one that ends it.
