Attorney's Deleted Kirk Post Resurfaces Amid ICE Shooting Fight
Kate Lincoln-Goldfinch represents Wilber Rafael Garces Perez, the Venezuelan national an ICE officer shot last Sunday in Austin.
She has spent the week on television challenging the federal government's account of that shooting.
A screenshot surfaced this week telling a different story about the woman doing the challenging.
In a post retired Air Force Lt. Col. Larry Brock Jr. preserved before she deleted it, Lincoln-Goldfinch wrote: "How do you resist getting shot in the neck? Does Charlie Kirk have any advice on that?"
Kirk was assassinated while speaking at a Utah college campus.
Turning Point USA was not going to let that comment disappear quietly.
Andrew Kolvet, executive producer of "The Charlie Kirk Show" and a TPUSA spokesman, told Fox News Digital the organization stands with the ICE officers involved in the Austin shooting.
"We stand with our brave men and women of ICE who are defending American sovereignty and keeping American citizens safe," Kolvet said.
Then he turned to the lawyer herself.
Kolvet called Lincoln-Goldfinch and her client a "perfect match," noting the man she represents had a final deportation order and led officers on a chase before he was shot.
Lincoln-Goldfinch told Fox News Digital her office determined the post "could be misconstrued" and removed it.
She did not explain what other meaning a joke about resisting a bullet to the neck was supposed to carry.
Surveillance Video Undercuts the Attorney's Version of the Shooting
While the Kirk post dominated social media, new video worked against Lincoln-Goldfinch's underlying case.
Newly released surveillance video backs the government's account: officers had their lights on and sirens going as they tried to stop Garces Perez, well before any shot was fired.
DHS confirmed the footage is authentic.
Lincoln-Goldfinch has claimed her client was simply making a DoorDash delivery and did not know federal agents were pursuing him.
Body camera video from responding Austin police tells a similar story – officers assisting Garces Perez out of the car, not yanking him out the way his side first claimed.
DHS says Garces Perez is a Venezuelan national with a final order of removal, and that his work authorization expired last year.
"No amount of smears and false narratives will slow down ICE from doing its job to arrest illegal aliens from our communities," the department said.
A federal judge has ordered Garces Perez to remain in the country through a Sept. 30 hearing, and Homeland Security Investigations and the FBI are now reviewing the shooting.
From Brooklyn to Austin, Democrats Reach for the Same Script
Here's the playbook, and it never changes.
An ICE encounter goes wrong, and within hours a practiced legal and media operation shows up with a sympathetic client, a camera-ready press conference, and a story that keeps shifting once the video surfaces.
Rep. Greg Casar didn't even wait for that video.
"Over and over, ICE has shot people and then lied about what happened," Casar said hours after the shooting – before surveillance video surfaced showing marked vehicles with their lights and sirens on, undercutting the very "ICE is lying" narrative he'd already signed onto.
Casar called it what he wanted it to be, not what the tape showed.
It happened last year in Franklin Park, Illinois, too, when an ICE agent fatally shot a driver who'd dragged an officer with his car – and the victim's girlfriend, Blanca Mora, still told reporters she believed ICE was lying.
It happened in Brooklyn years before that, when a shooting victim's brother said agents dragged their father "like an animal" before investigators had said a word about what led to the gunfire.
Now it's happening in Austin, except this time the attorney herself handed conservatives the evidence.
The same lawyer who told America not to trust ICE's account left behind a digital trail showing she could joke about a man's murder because of his politics.
That's not an unforced error.
That's the mask slipping on exactly how much good faith the other side brings to these cases, and it's why nobody with a "D" next to their name got the story right on day one.
Turning Point USA didn't need to exaggerate a thing – they just quoted her.
