DeSantis Tells Senate Republicans to Sleep in the Capitol Before Democrats Lock the Courts

Democrats just won enough Senate seats to strangle Donald Trump's judicial power for the rest of his presidency.

Justice Samuel Alito just confirmed he's staying on the bench anyway, and Ron DeSantis says that decision could cost conservatives for a decade.

Now DeSantis is telling Senate Republicans exactly what they need to do before the clock runs out.

DeSantis Says Trump Has Zero Shot at Another Justice

Alito, 76, told reporters Thursday he has no plans to retire. He's committed through the end of the current Supreme Court term in late June. On its face, that sounds like good news for conservatives who want a steady hand on the bench. It isn't.

Ron DeSantis spelled out the problem on X this week. He said the odds of Trump confirming a worthy successor to Alito or Clarence Thomas, 78, during the rest of this presidency are "zero."

Do the math. Democrats are projected to control roughly 55 Senate seats come January. Every Trump judicial nominee from this point forward walks into a brick wall built by Chuck Schumer.

Conservative legal analyst Ed Whelan laid out exactly how bad it is. He said if a Republican wins the White House in 2028, that president still won't be able to confirm a single justice or judge until Republicans win back the Senate. Whelan doesn't expect that to happen until 2033. He also named the senators who'd block Trump even in the current Senate if a seat opened now: Susan Collins and Lisa Murkowski among them, senators who'd rather protect their own image than hand Trump a win.

Remember who's run that kind of blockade before. Dick Durbin's Judiciary Committee spent years digging through Clarence Thomas and Samuel Alito's financial ties to conservative donors, and Durbin authorized a subpoena against legal advocate Leonard Leo to get there. Leo never complied, and Democrats lost their Senate majority before they could enforce it. Durbin is retiring, but the committee he built doesn't retire with him, and whoever takes his gavel in January inherits the same target list.

The Ginsburg Mistake Republicans Refuse to Repeat

Here's the part that should make every conservative's blood boil. Democrats already lived this exact nightmare and blamed the wrong people for it.

Barack Obama pressed Ruth Bader Ginsburg to retire in 2013. She refused. Reports at the time said she hoped to be succeeded by a woman in the Oval Office. Hillary Clinton lost. Ginsburg died in 2020. Donald Trump replaced her with Amy Coney Barrett, and the Supreme Court has had a 6-3 conservative majority ever since.

Liberal commentators spent years attacking anyone who suggested she step down, calling the pressure counterproductive. After Barrett was confirmed, some of those same liberals turned on Ginsburg herself.

Now Alito is making a different calculation under different pressure, and Republicans don't have the luxury of hoping he gets it right by accident. The Senate he's betting on confirming his successor doesn't exist anymore.

Grassley's Clock Is Already Running Out

This is why DeSantis isn't just venting on social media. He's demanding action.

He told Senate Republicans to roll cots into the Capitol cloakroom and live there until every pending Trump nominee gets a vote. More than 20 judicial nominees are rotting in limbo right now, including four appeals court picks. Senate Republicans have confirmed 56 judges since Trump returned to office. That's a start, not a finish line, and Schumer doesn't hand out extensions.

Chuck Grassley scheduled hearings for November 10 like there's a calendar year left to work with. There isn't. The new Senate gets sworn in January 3, and every day Republicans spend running a normal nine-to-five schedule is a nominee that dies on the vine. DeSantis isn't asking for urgency. He's asking why it took a landslide loss to produce any.

Alito's choice to stay keeps the conservative majority breathing for now. But a 76-year-old man's health is not a judicial strategy. If Alito or Thomas can't finish the term, the seat goes straight into a Democrat-run Judiciary Committee, the same one that already came after both men once, and out the other side with whoever Schumer's caucus can agree on.

Conservatives didn't spend a year winning back the White House just to lose the courts because Senate Republicans wanted their weekends off.
