China is running an industry that buys American citizenship for babies.
Now Trump just shut it down.
And the legal tool he used is the one the Supreme Court handed him five weeks ago.
The Business Nobody Wanted to Talk About
This isn't conspiracy theory. This is indictments.
In 2019, federal prosecutors unsealed charges against 19 people running Chinese birth tourism operations out of Southern California apartments – charging clients between $40,000 and $80,000 per birth.
One operation alone claimed to have served 8,000 pregnant women, half of them from China.
Florida operations catering primarily to Russian clients charge similar rates, and one Moscow agency head admitted the clientele has shifted. Her firm's customers used to be wealthy elites. Now, she said, "the middle class" is buying in too.
U.S. officials have pointed to news reports identifying more than 500 companies operating inside China alone that advertise these services.
The Center for Immigration Studies pegged American birth tourism at 35,000 cases in 2015. A year later, Chinese industry researchers put the number at 80,000.
Nobody in Washington wanted to touch it for decades.
Trump touched it on Thursday.
Miller Just Closed the Birth Tourism Loophole
The first executive order, titled "Continuing to Protect the Meaning and Value of American Citizenship," targets categories the Supreme Court itself acknowledged in Trump v. Barbara are not constitutionally protected: children of foreign terrorist organization members, children of Specially Designated Global Terrorists, and children of foreign government employees – embassy staff, consulate workers, and those acting on behalf of foreign governments.
This isn't a wild legal stretch. This is Trump reading the court's own language and using it.
The second order – the more powerful one – goes after the industry itself.
Stephen Miller made the point himself: no administration has ever moved this directly to deny visas to people entering the country for the sole purpose of giving birth here.
Consular officers can now reject those applications on suspicion alone.
The order also pushes DHS and the State Department to tighten screening together at the border, not separately.
The operators – the companies in China, the agencies in Miami and Moscow – now face law enforcement action simply for running the business.
Kavanaugh's Roadmap in Trump v. Barbara
Here is what the left does not want you to notice about Trump v. Barbara.
Roberts wrote the majority. But the vote was 6-3, and Justice Kavanaugh – a Trump appointee – gave the administration something more valuable than a win.
He gave them a roadmap.
Kavanaugh wrote that while Trump's original order ran afoul of existing federal statute, Congress could amend that statute. He wrote explicitly that the 14th Amendment would not prevent lawmakers from creating new exceptions for children born to parents unlawfully or temporarily present.
That was June 30th.
Trump's legal team spent five weeks reading that roadmap.
The August 6th orders operate within the exceptions Barbara itself recognized – diplomatic exceptions have existed since the founding – and they lean on executive authority over visa issuance that courts have historically left alone.
Will Scharf, White House staff secretary, said the orders rely on "legally validated means" that do not conflict with the Supreme Court's ruling.
He is correct.
Thirty Years of Democrats Ignoring Birth Tourism
Democrats built this industry by refusing to enforce the law.
For 30 years, Democrat-run agencies watched companies sell American passports for tens of thousands of dollars apiece and did nothing – because calling it fraud meant admitting the citizenship system they defend was never built to survive contact with people determined to game it.
Say it plainly: Democrats let foreign nationals buy their way into the American family, then called anyone who objected a racist.
Trump is the first president with the spine to call it what it actually is.
Stephen Miller labeled it correctly: fraud. Foreign nationals used tourist visas for a purpose those visas were never meant to serve, and walked away with citizenship for a child who was never supposed to have it.
Trump and Republican allies are already pushing Congress to amend the statute Kavanaugh flagged, hoping to tip the math the next time this fight lands back at the Supreme Court.
If it does, the justices take up birthright citizenship again with a 6-3 court that just told you one of those six is open to change.
Trump did not lose at the Supreme Court and walk away.
He read the opinion, found the opening, and moved in five weeks.
That is not a setback. That is a strategy.
